Independent Professional Terms

1. Independent professional status

Each expert acknowledges that they are an independent professional and not an employee, agent, partner, representative, franchisee, joint venturer, or contractor of Ownlybiz for service delivery purposes. Experts are solely responsible for their services, client outcomes, qualifications, licenses, insurance, taxes, records, disclosures, legal compliance, and professional conduct.

2. Expert responsibility for clients

Experts are responsible for all advice, statements, deliverables, claims, pricing, refunds, disputes, chargebacks, and services they provide. Ownlybiz does not guarantee clients, revenue, leads, bookings, outcomes, ratings, search placement, email opens, delivery, uninterrupted availability, video/audio quality, checkout availability, payout timing, or payment processor decisions. Experts should keep reasonable backup records and client communication procedures for their own business.

3. Regulated and high-risk services

Experts must not provide regulated medical, legal, financial, tax, investment, therapy, immigration, insurance, or similar professional services unless properly licensed, authorized, insured, and legally permitted in every applicable jurisdiction. Experts must not misrepresent credentials or outcomes.

4. Indemnity and recovery

Experts agree to defend, indemnify, and hold Ownlybiz harmless from claims, losses, processor fees, refunds, chargebacks, penalties, legal costs, and damages arising from their services, content, client relationships, legal violations, prohibited services, taxes, or breach of these terms. Ownlybiz may offset or recover amounts connected to expert-caused disputes, chargebacks, refunds, fraud, or policy violations.

5. Client data and GDPR duties

Experts must handle client personal data lawfully, securely, and only for appropriate service purposes. Where an expert acts as a controller, the expert is responsible for lawful basis, notices, retention, data-subject requests, breach obligations, and any required agreements or records.

6. No prohibited circumvention

Experts may not use Ownlybiz to evade processor rules, manipulate free minutes, create fake sessions, inflate revenue, bypass fees, deceive clients, or move disputes off-platform to avoid records.
